The District’s Civil Rights Compliance Officers will coordinate the district’s efforts to comply with its responsibilities under applicable non-discrimination and anti-harassment laws and regulations including, but not limited to the Americans with Disabilities Act of 1990, Section 504 of the Rehabilitation Act of 1973, Title VI of the Civil Rights Act of 1964, the Age Discrimination Act of 1975, and other applicable federal and state civil rights laws.

In accordance with the New York State Dignity for All Students Act (DASA), the District prohibits discrimination, harassment, and bullying of students by school employees or students on school property, schoolsponsored activities, and at school-sponsored functions. Reports of discrimination or harassment based on a protected characteristic under DASA may be filed with the appropriate District staff and will be addressed under the District’s DASA procedures. (NY requirement for public schools.)

Asbestos Management Plan
Federal regulations require that schools be inspected for the presence of asbestos, a toxic material that has been used in the construction industry for a number of years. Our schools have been inspected for asbestos containing materials and the results of the inspections are contained in the Asbestos Management Plan. This plan has been sent to the State authority in charge of Asbestos Abatement. The Asbestos Management Plan includes the results of all the inspections conducted on all the school buildings. It also contains the results of the material samples which were taken during the inspections and the plans for asbestos abatement. The Asbestos Management Plan is available for review during regular working hours at each school's main office. A copy of the Asbestos Management Plan will be made, on request, for a nominal fee to cover the cost of copying and handling. Notification of Pesticide Application
The Pleasantville Union Free School District is required by State Education Law to maintain a list of persons in parental relation, faculty and staff who wish to receive 48-hour prior written notification of certain pesticide applications.
The following pesticide applications are not subject to prior notification requirements:
- a school remains unoccupied for a continuous 72-hours following an application;
- anti-microbial products;
- nonvolatile rodenticides in tamper resistant bait stations in areas inaccessible to children;
- nonvolatile insecticidal baits in tamper resistant bait stations in areas inaccessible to children;
- boric acid and disodium octaborate tetrahydrate;
- the application of EPA designated biopesticides;
- the application of EPA designated exempt materials under 4OCFR1 52.25;
- the use of aerosol products with a directed spray in containers of 18 fluid ounces or less when used to protect individuals from an imminent threat from stinging and biting insects including venomous spiders, bees, wasps, and hornets.
In the event of an emergency application necessary to protect against an imminent threat to human health, a good faith effort will be made to supply written notification to those on the 48-hour prior notification list.

Individuals who believe they have been subjected to discrimination, harassment, or retaliation in violation of the District’s non-discrimination policies may file a complaint with the appropriate District compliance coordinator. Complaints should be filed as soon as possible and may be submitted in writing to the compliance coordinator responsible for the relevant policy area (e.g., Title IX, Section 504/ADA, Civil Rights). The District will promptly and thoroughly investigate complaints in accordance with its adopted grievance procedures and will notify the complainant and respondent of the outcome.
In addition to District complaint procedures, individuals may file complaints with external agencies, including:
- New York State Education Department (NYSED) for violations of state or federal education civil rights requirements;
- New York State Division of Human Rights (DHR) for matters under the New York State Human Rights Law;
- U.S. Department of Education, Office for Civil Rights (OCR) for violations of federal civil rights laws.

The District prohibits retaliation against any individual who files a complaint of discrimination, participates in an investigation, or exercises any right protected by civil rights laws. Retaliation itself is unlawful and may lead to disciplinary action independent of the underlying complaint.

Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act prohibit discrimination on the basis of disability. The District does not discriminate against qualified individuals with disabilities and will provide reasonable accommodations to ensure equal access to educational programs and activities for students, employees, and others as required by law. (Extended language based on standard NY practice; Pleasantville lists ADA/504 among statutes compliance officers oversee.)

Title IX of the Education Amendments of 1972 prohibits discrimination on the basis of sex in federally funded education programs and activities. Title IX provides that no person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance. Sexual harassment, sexual violence, and other forms of sex-based discrimination are prohibited under Title IX.
